All services are subject to separate written agreements that will contain specific terms, conditions, timelines, and pricing for each project.

User Obligations

When using our website or services, you agree to:

• Provide accurate and complete information when requesting quotes or services
• Use our website and services only for lawful purposes
• Not interfere with or disrupt our website or services
• Respect the intellectual property rights of pixelrise and third parties
• Comply with all applicable laws and regulations
• Pay all agreed fees and charges in accordance with project agreements

Project Agreements

All construction projects undertaken by pixelrise will be governed by separate written agreements that will include:

• Warranty and guarantee terms

In case of any conflict between these Terms of Service and a specific project agreement, the project agreement shall take precedence.

Pricing and Payment

All pricing for construction services will be detailed in individual project agreements. General terms include:

• Quotes are valid for 30 days unless otherwise specified
• Payment terms will be specified in each project agreement
• Late payment may result in project delays and additional charges
• Changes to project scope may affect pricing and timeline
• All prices are exclusive of VAT unless otherwise stated

Intellectual Property

The content on this website, including text, graphics, logos, images, and software, is the property of pixelrise B.V. or its licensors and is protected by Dutch and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

Any designs, plans, or specifications created by pixelrise for your project remain our intellectual property until full payment is received, at which point ownership rights will be transferred as specified in the project agreement.

Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms of Service. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by Dutch law:

• pixelrise's total liability for any claim related to our services shall not exceed the total amount paid by you for the specific project giving rise to the claim
• We shall not be liable for any indirect, incidental, special, or consequential damages
• We shall not be liable for delays or failures in performance due to circumstances beyond our reasonable control
• Our liability for defects in workmanship is limited to repair or replacement as specified in project warranties

Nothing in these terms shall limit our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

Warranties and Guarantees

pixelrise provides warranties on workmanship as specified in individual project agreements. General warranty terms include:

• Workmanship warranties typically range from 1-2 years depending on the type of work
• Material warranties are as provided by manufacturers
• Warranties do not cover normal wear and tear or damage caused by misuse
• Warranty claims must be reported promptly in writing

Force Majeure

Neither party shall be liable for any delay or failure in performance due to events beyond their reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, or supply chain disruptions.

Governing Law

These Terms of Service and any disputes arising from them shall be governed by and construed in accordance with Dutch law. Any legal proceedings shall be brought exclusively in the competent courts of the Netherlands.

If you are a consumer residing in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Dispute Resolution

We encourage resolution of any disputes through direct communication. If a dispute cannot be resolved amicably, we are willing to participate in mediation before resorting to litigation. For consumer disputes, you may also be entitled to use alternative dispute resolution procedures.

Termination

These Terms of Service remain in effect while you use our website or services. We may terminate or suspend your access to our website immediately, without prior notice, if you breach these terms.

Project-specific agreements may be terminated only in accordance with the termination provisions contained within those agreements. Early termination may result in additional charges for work completed and materials ordered.

Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.

Changes to Terms

pixelrise reserves the right to modify these Terms of Service at any time. We will notify users of any material changes by posting the updated terms on our website. Your continued use of our website or services after such modifications constitutes acceptance of the updated terms.
